A deed-back (also called a voluntary surrender) is one of the cleanest ways to exit a timeshare: you return your ownership interest to the developer, and your ongoing fee obligations end. It sounds simple, but the process has requirements and limitations that every owner should understand.
How Deed-Back Programs Work
In a deed-back, you transfer your ownership interest back to the resort developer or management entity. The developer accepts the return at their discretion — they are not required to take it back. If accepted, you typically give up all future usage rights, and the developer releases you from future maintenance fee obligations.
Some programs charge a processing fee. Others do not. The terms vary by developer and can change over time.
Common Eligibility Requirements
While every developer sets its own rules, the most common eligibility factors include being current on all maintenance fees (no past-due balance), having no outstanding loan or financing balance (paid in full), having a clean account with no active disputes or chargebacks, and submitting a formal written request through the correct department.
Which Developers Offer Deed-Back Programs?
Several major Florida-based developers have operated deed-back or surrender programs, including Wyndham (Club Wyndham), Marriott Vacations, Hilton Grand Vacations, and Diamond Resorts. However, the availability and terms of these programs can change without notice, and not all owners or all products within a brand will qualify.
The only way to know if you qualify is to submit a written request and ask for the current eligibility requirements in writing.
When Deed-Back Is Not Available
If you are behind on payments, still financing the purchase, or the developer simply declines to accept the return, you need to explore other exit paths. Misrepresentation-based approaches, attorney-assisted disputes, and (with appropriate caution about consequences) strategic default are all alternatives that may apply depending on your situation.
